The Collapse of the 28-Clause Ceasefire Plan for Ukraine: Why Peace Negotiations Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the diplomatic emergency triggered by the announcement of a new 28-point plan for resolving the conflict appeared – momentarily – to have been stabilised. A senior US official spoke of "substantial progress" after diplomatic discussions in Geneva. On Monday night, the Kremlin made its retaliation: an extensive attack of aerial bombardment on Kyiv.

The Cycle of Diplomacy and Destruction

The sequence of opposing developments captured the bleak nature of the outgoing year. By day, political struggles are waged: hopeful statements are released from various governments. Considerable effort is devoted on containing particular approaches. By night, Russian leadership forcefully demonstrates the world that, for them, military action persists as the key method for achieving "peace".

After-Dark Attacks

As Russia's attack developed into the early hours of Tuesday, the present situation of Ukraine's defenselessness was laid bare. Ukraine is able to track projectile deployments from Russian territory, a ability provided through up-to-date information. From observation points, Ukrainian air force fighter jets that had been deployed to intercept incoming cruise missiles roared overhead – modern combat jets delivered to Ukraine by European allies.

Moments later, Kyiv's missile defense engaged: defensive missiles fired to intercept a incoming threat. This was a modern interception technology at work, presumably provided by allied countries. Every launch jolts you unexpectedly, shaking the windows. The moment of terror quickly becomes resigned acknowledgment: maybe the approaching threat won't strike its target this time, sparing the city from ruin and additional electricity failures.

Continuous Dangers

Not long after, a heavy machine gun opened up on a drone close by, part of a rapid response unit – most likely Western-made equipment. Unfortunately, the shots failed to hit the hostile drone – it continued its flight toward its objective.

With pauses, this persisted until dawn. Kyiv awoke to the daybreak reports: several casualties, damage and heating outages in numerous residences as a result of the evening attack. As always, everyone still continued their routines – enduring hostilities. But those entire period encapsulated Ukraine's critical military reliance on external assistance – a reliance that neighboring countries are demonstrably unable to replace in the immediate future.

Ineffective Peace Efforts

The comprehensive proposal from US administration provoked deep reactions, debate and profound anxiety – and briefly redirected concern from Ukraine's largest corruption scandal in years. Yet, we have experienced comparable situations, after prior negotiation attempts and international summits.

Every new proposal from Washington unfolds according to the consistent cycle: a negotiation push against Ukraine, which Kyiv, with partner nations, effectively counters. They contain the crisis but never actually achieve victory. This pattern will, no doubt, persist.

Political Considerations

It is tempting to accuse specific actors of persistently promoting Russian terms. But that does not seem to be the entire situation. American leadership works based on a premise understood by seasoned negotiators: you cannot secure via talks what you have been unable to protect through force. The White House believes that it is impossible to force Russia to surrender the territory that it presently holds in Ukraine's southern or eastern regions.

The challenge is that while recognising this factual reality, American administration does little to prevent Kremlin actions, through statements or actions, from assuming that the status quo will not change more in its benefit in the months ahead.

Conflicting Perspectives

Therefore, Moscow is convinced that the clock favors them – that Ukraine and its partners are coming close to fatigue. Their incentive to agree to terms that does not give them the greatest potential benefit is virtually nonexistent. There may be multiple initiatives to achieve ceasefire, but they will carry on as long as Russia's leader remains completely certain in the outcome.

On the contrary, Ukraine's government believes that Ukraine can still persist, gradually sacrificing civilians and areas but averting a complete military breakdown until conditions improve in its favour.

Present Conditions

Objectively, there are no real preconditions for a ceasefire. Now, individual motivations are entering the equation: personal goals to negotiate peace and achieve global acclaim, and Ukrainian leadership's double obstacles – on one hand, not to estrange crucial supporters, and on the other, to rally Ukrainians around the country's interests against any initiative Kyiv finds unworkable, so that their priority does not switch to internal issues. And although their objective will now be significantly challenging after recent developments, it remains quite doubtful that this will modify their basic position.

These two forces are driving the talks.

Summary and Prospects

It took a just a single week to terminate the suggested clauses of the latest plan. Aggressive and erratic handling of the matter by Washington, pushback by Ukraine and the remaining European nations, along with pacifying measures of representatives, and finally, latest revelations, all served their function.

While new proposals based on old ideas are forthcoming, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to counter political attacks from Washington that are rooted in Kremlin requirements and reflect certain reluctance to change the course of events, if they remain united and improve their protective measures at a much faster pace. If they do, no combination of diplomatic or military actions will be able to overcome them. In the meantime, Ukraine's ability to counter nocturnal attacks will, for the foreseeable future, primarily depend on sustained allied backing.
